MANTIOWOC COUNTY, Wisc. (WTHR) – Steven Avery, who is serving a life sentence for the murder of Teresa Halbach, has won the right to appeal.

His lawyer, Kathleen Zellner, has maintained his innocence and recently made an appeal, arguing that bones on the Avery property were never tested for DNA, according to the BBC.

Avery and his nephew Brendan Dassey were both sentenced to jail for life for killing Halbach. Her burnt remains were found on the Avery property a week after she went to photograph a minivan in the Avery's salvage yard.

"The case is being remanded back to the circuit court to conduct proceedings, which may include a hearing. The circuit court may grant a new trial, or if not, back to appellate court who may reverse the conviction and / or grant a new trial , "Zellner told Newsweek.

Avery has served 18 years in prison for another crime he did not commit.
