LAW ON THE AMENDMENT OF THE LAW ON EVALUATION AND CLASSIFICATION OF FILMS OF CINEMA

ARTICLE 1 – The phrase "commercial circulation and exhibition" of paragraph (f) of the first paragraph of article 3 of the Law on the evaluation and classification of motion pictures on 14/7/2004 and numbered 5224 has been changed to "commercial circulation or exhibition", yürürlük Essentially yürürlük was removed from the text of the article, the following paragraph was added to the paragraph and (c), (d), (e) and (g) were deleted.

Travel and accommodation expenses of support committees and members of the Commission shall be borne by the Ministry.

ARTICLE 3 – Article 7 of Law 5224 was amended as follows.

ARTICLE 7 – Films produced or imported in the country will be evaluated and classified before commercial circulation or presentation, and films that are not suitable for evaluation and classification will not be offered for commercial circulation and demonstration.

Film films that are not rated and rated; At festivals, special exhibitions and similar cultural and artistic events, it is indicated only by an age mark of more than 18 years. The films, which have been evaluated and classified by the Ministry before, are shown according to the signs and phrases they have received in related activities. It is mandatory to use the signs and phrases that the films to be displayed in these events should be used in all types of presentations and demonstration areas.

Article 4 – Article 8 of Law No. 5224 is amended as follows.

ARTICLE 8 – Requests for support are made by individuals or legal entities resident in the country.

Quantity of support; project development can not exceed 50% of the total budget specified in the application for the first films of fiction, feature film, film production, co-production, documentary production, post-production, distribution and promotion. Any total budget stated on the request for production of animated films, production of short films, screenplay and dialogue writing, and types of home movie display support can be supported. The amount of support for the type of support for the production of foreign films must not exceed 30% of the amount spent in the country and accepted by the Ministry.

All media within the scope of this Act are given as non-refundable.

In the event that the obligations specified in the law, regulation and support agreement are not fulfilled or the support is unfairly determined, the amount of the support will be calculated in accordance with Article 51 of Law 6183 on the Procedure for Collection of Public Receivables dated 21/7/1953 for the period from the date of payment. taken in conjunction with. The Ministry will inform the supporter the support to be reimbursed within one month from the amount of support and interest for the support to be returned. The amounts not paid within this period must be monitored and collected by the relevant tax administration on the notification of the Ministry, in accordance with the provisions of Law No. 6183.

Application requirements for support, evaluation criteria, responsibilities of the supporter, forms of payment, expense documents, delivery deadlines, warranty and guarantee provisions and other matters will be determined by the regulation to be issued by the Ministry.

ARTICLE 5 – Article 9 of Law No. 5.224 was amended with the following title.

"Activities and projects and support of film artists

ARTICLE 9 – The Ministry may support, organize and reward prizes in the field of activities, projects and activities in the field of cinema. Participate in international festivals and competitions and promote promotional activities related to them.

The Ministry can provide support to public institutions, organizations and public legal entities by providing financial support to needy film artists or film industry officials.

ARTICLE 6 – The following clause was added to Article 10 of Law No. 5224.

"The Ministry may obtain copies of replicated works or copies of national or foreign material and other film-related materials for the purpose of creating a file or museum in the field of cinema."

ARTICLE 7 – Article 11 of Law No. 5224 is amended as follows.

ARTICLE 11 – For the purposes of this Law;

a) Shares in accordance with points (1) and (2) of subsection (i) of the first paragraph of article 21 of the Municipal Revenue Law of May 26, 1981 and numbered 2464,

b) Fees to be taken by the Ministry under this Law,

The Ministry is credited to the Central Accounting Unit. These amounts are deposited in the budget. Each year, the appropriate amount is also allocated to the relevant units, not less than the amount recorded in the budget for the final year. The unused amounts are recorded as appropriations subordinated to the budget of the Ministry in the following year.

The Ministry is authorized to enter into commitments and contracts for future years, provided that the Presidency has the appropriate opinion for the types of support mentioned in this Law.

The Ministry's budget, the resources of the Central Direction of the Revolving Fund and the special accounts of the Ministry may be used for the support specified in this Law.

ARTICLE 8 – Article 13 of Law No. 5224 was amended with the following title.

"Use and control of signs and phrases

ARTICLE 13 – Failure to comply with the obligation to evaluate and classify, use of signs and phrases in the form of advertising and demonstration after evaluation and classification and misuse of the material in the support material shall be suspended until the use and representation of the films by the authority be used until signs and phrases are used. and the administrative fines provided for in this article.

In contradiction with the provisions of this Law;

(a) 20 thousand Turkish lire for the filmmaker who does not comply with the obligation to assess and classify and use the necessary signs and phrases in a misleading manner,

(b) Twenty thousand Turkish lire for those who distribute films which do not comply with the obligation of assessment and classification,

(f) Fifty thousand Turkish lira for those who demonstrate films which do not comply with the obligation of assessment and classification, and those who make films using the necessary and erroneous signs and phrases,

d) Twenty thousand Turkish lira per film for event organizers without using the necessary signs and phrases in the areas of advertising and publicity,

(e) Fifty thousand Turkish lira per room per hour for theater operators who exhibit without advertisement, trailer and length of the film,

(f) fifty thousand Turkish lira in the hall of the company's property, which acts against the provisions of the third and fourth paragraphs,

(g) fifty thousand Turkish lira per room for cinema operators who do not comply with the obligation laid down in the fifth paragraph;

administrative fines.

The administrative fines provided for in this Article shall be granted by the local administrative authority. Administrative fines shall be paid within one month of the date of notification. The payment of the administrative fine does not eliminate the obligations.

Under this Law, audit committees are established by the local administrative authorities to carry out the audits.

The principles and procedures for the application of this article shall be determined by the regulation to be issued by the Ministry.

ARTICLE 9 – Article 14 of Law No. 5224 was amended with the title as follows.

"Film shooting coordination commission and shooting permit

ARTICLE 14 – In order to determine the needs and solutions related to film and film series, to ensure coordination between institutions and determine shooting rates and safety principles in public areas, a filming coordination committee shall be established by the Ministry in the provinces where necessary.

In the provinces with a filming coordination commission, no fee can be determined beyond the specified filming fee rate of the film.

The amount of the fee determined for cinematographic and serial films shall be deposited in the relevant accounts of the public institutions and organizations or of the accounting units of the local authorities. In the case where public institutions and organizations responsible for the shooting area are public institutions and organizations included in the central government budget, the value of the salary is recorded as revenue in the general budget.

The provisions of this Act prior to the entry into force of this article and the reimbursements of this Act prior to the amendment of this Article shall continue to be applied.

In the provinces where the filming coordination commission is established, the tariffs determined prior to the tariff determination are not applied.

ARTICLE 11 – The first paragraph of article 1 of Law no. 5,244, of July 14, 2004 and the first paragraph of article 2 of Law no. 2 of five registration and registration bases, was withdrawn from the text of the article and articles 5, 12 and 15. were repealed.

ARTICLE 12 – This law;

a) the second and third paragraphs of article 13 of Law 5.224, as amended by article 8;
